Digital License Agreement

This site is owned and controlled by John Jacoberger (the photographer).  All content including text, graphics, images is either owned by the photographer or a content provider. 

By purchasing a digital image from this site, you agree to be bound by these Terms and Conditions of Use.  Please read this agreement in its entirety.

Personal Use License:

The photographer grants the purchaser of a digital image a personal use license to download and copy the image with the following usage restrictions:

• The digital image is for personal use only. The image may only be used on personal computers or printed for personal use, either by the purchaser or by a professional print service.
• The digital image may not be copied, except for a temporary transfer to digital media to be printed by a professional print service.
• The digital image may not be used for any commercial purpose or any means for which you collect money or collect fees, and the image may not be used in advertising.
• The image title, description, ownership and all remain with the photographer now and in the future.
• There are no warranties, either express or implied. All images are provided ‘as is.’
• The photographer shall not be liable for any third party claims or incidental, consequential or other damages due to the purchaser’s use of the image(s).

The photographer grants the purchaser of a digital image a commercial use license to use the image with the following restrictions:

If you wish to use any images or parts of an image for commercial purposes, please contact the photographer.  Pricing and terms of the commercial use will be negotiated and agreed upon at that time.  No image(s) purchased from the photographer may be used in any marketing or promotional materials used for advertising distributed to the public, via print, broadcasting, web pages, e-mail, or any other means without prior consent of the photographer.

• Images may be used for advertising, promotion, brochures or packaging
• Images may be used for promotional purposes on a commercial website
• Images may be distributed in prints, posters, flyers for promotional purposes not for resale
• Images may be used in books, magazines, newspapers or other printed media
• Images may appear in video or broadcast

The purchaser may not resell, relicense or redistribute any images without express permission of the photographer.  No images or parts of images may be used in a pornographic, obscene, illegal, immoral, libelous or defamatory manner.  No images may be incorporated in trademarks or logos.  Images may not be made available for download.

The photographer shall retain all rights, ownership, title, license,  and copyright of the images.

There shall be no warranty, express or implied for digital media.  The photographer shall not be liable for any claims, incidental, consequential or other damages due to the purchaser’s use of the images.
